CAMI Urges Mining and Quarry Right Holders to Fulfill 2024 Payment Obligations

The Mining Registry (CAMI), the official portal for the Democratic Republic of Congo’s extractive sector, has issued a reminder to holders of mining and quarry rights.

As of December 15, 2024, payments for annual surface rights for the 2024 financial year have not been confirmed by CAMI’s financial services.

In a press release, CAMI’s Director General, Popol Mabolia, called on the affected holders to submit original proof of payment for both the CAMI quota and the DGRAD quota. The submission deadline is 45 days from the publication of the press release.

Failure to comply within this timeframe will result in the loss of rights, as stipulated under Article 287 of the Mining Code. This article outlines the process for addressing non-payment of surface rights, including:

  • Detection and Notification: CAMI identifies instances of non-payment at the end of each year’s first quarter. Affected parties are notified, and a list of non-compliant holders is displayed in a designated area and published in relevant provincial and national press outlets.
  • Defense Submission: Listed holders have 45 days from the publication date to present evidence of payment or a valid defense, such as force majeure.
  • Review and Decision: CAMI reviews defense submissions within 30 days after the defense period ends. Cases of non-compliance are forwarded to the Minister along with a cadastral opinion and a draft forfeiture decision.

This reminder underscores the importance of timely compliance to avoid the forfeiture of mining or quarry rights. CAMI’s measures aim to ensure transparency and adherence to regulatory obligations in the Congolese mining sector.
